Michigan Auto Law operates under the no-fault insurance system, which means that your own insurance company pays for your medical bills and lost wages after a crash, regardless of who caused the accident/ who is at fault. Your No-Fault insurance will also pay for replacement services up to $20.00 per day and for Attendant Care to help take care of you at home if that is medically necessary. This insurance coverage is known as Personal Injury Protection or “PIP” and ensures the rapid payment of medical bills and financial assistance. If you are injured, you must file a PIP claim with your insurer within one year of the accident to secure these extremely important benefits.

To make a claim against or sue the at-fault driver who caused the crash in which you were injured for additional damages like the Pain and Suffering you are enduring or have endured, your injuries must constitute a Serious Impairment of a Body Function or involve a Permanent Disfigurement (scarring or loss of limb). The impairment of a body function must affect your general ability to lead a normal life for at least some period of time after the crash.
